âšī¸ This is a summary of key terms only. By proceeding with payment, you confirm that you have read these terms and agree to the full Rental Agreement that will be provided to you via email.
1. Parties
This agreement is between Latino Rentals Pty Ltd (ACN 670 173 743), located at Unit 10/151 Capel St, North Melbourne VIC 3051 ("the Company") and you, the renter ("the Client").
2. Payment Terms
- First payment: Security bond + first week's rent, payable via Stripe at the time of booking
- Ongoing rent: Weekly payment via bank transfer, due every 7 days from rental start date
- Bank details: Latino Rentals PTY LTD | BSB: 063 464 | Account: 11 104 574
- Late payment: $5/day fee applies. After 14 days overdue: $10/day and the e-bike must be returned immediately
- A Stripe processing surcharge (1.7% + $0.30) applies to card payments and is passed on to the Client
3. Security Bond
- $200 (International Students) | $500 (Working Holiday Visa / Australian Citizen or PR)
- The bond is fully refundable within 5-8 business days after the e-bike is returned in acceptable condition
- Deductions may be made for: outstanding rent, damage beyond normal wear and tear, missing accessories, or cleaning if the e-bike is returned in unreasonable condition
- An itemised statement of any deductions will be provided to the Client
4. Card Authorization
- By paying, you authorize Latino Rentals to securely store your payment card details
- Your stored card may only be charged for amounts specified in this agreement: late fees, theft, loss, or damage costs
- You will be notified in writing (via email or SMS) before any additional charge is made to your stored card, with an itemised breakdown of the amount and reason
- You have 48 hours to dispute any charge by contacting us at customer@latinorentals.com.au
5. Theft, Loss & Damage
- No insurance is available in Australia for privately rented e-bikes. You accept full responsibility for the e-bike while in your possession
- Theft/total loss replacement costs:
- Complete e-bike: $2,545 (discounted from retail replacement value)
- Battery only: $1,050
- Screen/display: $350
- Frame: $950 minimum
- In the event of theft, you must file a police report within 24 hours and provide the report number to Latino Rentals
- Weekly rent continues to accrue until the replacement cost is paid in full or a payment plan is agreed upon
- Payment plans: If you cannot pay the full amount immediately, Latino Rentals may offer a structured payment plan. The terms will be documented in a separate written agreement signed by both parties
- Failure to pay may result in the matter being referred to a third-party debt recovery agency. All reasonable collection costs will be added to the outstanding amount
6. Minimum Rental Period & Cancellation
- The minimum rental period is specified at the time of booking
- To end your rental, provide at least 7 days written notice (email or SMS)
- Cancellation without notice: $45 early return fee applies
- Early cancellation (before minimum period): $45/week for each remaining week of the minimum period
7. E-Bike Condition & Return
- A condition report with photos will be completed at pickup. Both parties receive a copy
- The Client must take a video of the e-bike's condition before returning it
- Normal wear and tear is accepted. You will not be charged for reasonable use
- Damage beyond normal wear and tear will be assessed and an itemised cost provided
- Return address: Unit 10/151 Capel St, North Melbourne VIC 3051
- Returns must be scheduled during business hours. Returns outside business hours are at the Client's risk until inspection is completed
8. Your Responsibilities
- ALWAYS lock the e-bike with the provided lock at every stop
- ALWAYS remove and take the battery with you when leaving the e-bike unattended
- NEVER leave the e-bike outside overnight
- Comply with all Victorian road rules and traffic laws
- Legal speed limit for e-bikes in Australia: 25 km/h
- You must not modify, tamper with, or alter the e-bike or its components
- You must not sublet, lend, or transfer the e-bike to any other person
- Report any mechanical issues or damage within 24 hours to customer@latinorentals.com.au
9. Maintenance
- Included: Regular maintenance (brake adjustments, tyre inflation, lights, horn)
- Not included: Flat tyres, accidental damage, cosmetic damage
- Optional extended maintenance coverage available: +$15/week (covers flat tyres and minor accidental damage)
- All repairs must be carried out by Latino Rentals or an approved repairer. Unauthorised repairs void any maintenance coverage
10. Limitation of Liability
- Latino Rentals is responsible for providing an e-bike in safe, roadworthy condition at the time of pickup
- Latino Rentals is not liable for any indirect loss, injury, or damage arising from the use of the e-bike, to the maximum extent permitted by law
- Nothing in this agreement excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (Competition and Consumer Act 2010)
11. Disputes
- Any dispute should first be raised in writing to customer@latinorentals.com.au
- Latino Rentals will respond within 5 business days
- If the dispute cannot be resolved, either party may apply to the Victorian Civil and Administrative Tribunal (VCAT) or seek mediation through Consumer Affairs Victoria
- This agreement is governed by the laws of the State of Victoria, Australia
12. Privacy
- Personal information collected (name, email, phone, ID) is used solely for managing your rental agreement
- Your information will not be shared with third parties except as required by law or for debt recovery purposes
- Payment information is processed securely by Stripe and is not stored on our servers
